Terms of Service (ToS)

Terms of Service (also called Terms and Conditions or Terms of Use) is a binding legal agreement that establishes the rules users must follow when using your product or service. It defines acceptable use, intellectual property ownership, payment terms, limitation of liability, and dispute resolution.

Unlike a privacy policy (which is legally required), terms of service are technically optional — but practically essential for any business. Without ToS, you have no contractual basis to terminate abusive accounts, protect your IP, or limit your liability for damages.

Key clauses in a well-drafted ToS include: account creation and termination, payment and refund policy, prohibited activities, intellectual property ownership, warranty disclaimers, limitation of liability, governing law, and dispute resolution.
